Are THC drinks legal in Illinois? Starting Thursday, Nov. 12, 2026, any hemp drink with more than 0.4 mg of total THC per container is legally cannabis in Illinois and may be sold only by a licensed cannabis dispensary, according to the Illinois Department of Revenue. Status as of Nov. 2, 2026: the rule takes effect Nov. 12 under state law, regardless of the separate federal Dec. 11 date.

What changes on Nov. 12

IDOR Informational Bulletin FY 2027-04 explains the change for every business that possesses or sells consumable or topical hemp products:

  • Over 0.4 mg total THC per container = cannabis. Those products no longer meet the definition of hemp and fall under the Cannabis Regulation and Tax Act.
  • Only IDFPR-licensed dispensaries may sell products above that line, and those products must meet every cannabis-law requirement.
  • Hemp products under the new Illinois Hemp Act cannot contain alcohol, tobacco or nicotine, must be prepackaged and must meet testing, labeling and child-resistant packaging rules.
  • Illinois is not waiting for Washington. The state plans to enforce on Nov. 12 even though related federal enforcement is currently set for Dec. 11, 2026.

What Peoria-area stores are doing

As reported by the Peoria Journal Star, retailers are winding down THC drink sales ahead of the deadline. The paper reported that Binny’s website announced markdowns on THC beverages still in stock. A Peoria City/County Health Department official, as quoted, said “public health was kind of stuck in the middle.”

Can leftover drinks move to dispensary shelves?

Not under anything in the bulletin. It requires full cannabis supply-chain compliance and does not create a general route for a dispensary to take in and sell former hemp-store beverage inventory. IDOR instead lists options such as stopping orders, returning products to distributors and coordinating redistribution to other states where some products may still be sold until Dec. 11. Selling reclassified products without a license can bring civil and criminal penalties, product seizure and tax, penalty and interest.
