DEA Pushes Back on Marijuana Rescheduling Delays (CLN, Oct. 18, 2026)
DEA is pushing back on additional GAO briefing while opponents seek to reopen the marijuana rescheduling hearing. In his Oct. 14 order, the judge directed a response to that separate reopening motion by Oct. 21, 2026, reserved the GAO-report question and continued the stay. That order did not reopen the hearing.
Thomas Howard and Miggy also cover Illinois hemp enforcement on Nov. 12, Illinois’ Nov. 1 label deadline, Massachusetts Question 8, South Dakota’s attorney general opinion on rescheduling, the Sixth Circuit’s Hello Farms ruling, Aurora and Curaleaf, a Supreme Court gun-rights denial and Colorado’s vape recall. Recorded live Oct. 18, 2026.

Context at recording: Illinois’ Nov. 12 date is state guidance, not yet in effect. The Oct. 14 DEA order continued the stay and did not reopen the hearing. Question 8 hasn’t been decided. The Hello Farms rehearing request is as reported. Aurora hasn’t accepted any offer. A cert denial isn’t a merits ruling.
